Student and Terms of use Policies
1. SAGE Didactic Pty Ltd ABN 47 124 249 921 (“SAGE”), in association with its education partners, has developed training modules and courses in leading edge automation principles and applications (“Course(s)”). SAGE also offers these Courses and other training and resource services online (“Online Service(s)”).
2. SAGE aims to provide its students a conducive and stimulating learning environment and for this purpose has adopted the following Student and Terms of Use Policies (“Policies”).
3. The Student Policies govern SAGE’s academic procedures, student enrolments and the general conduct of students enrolled in a Course.
4. The Terms of Use Policy governs the use of the Online Services.
5. It is a condition of a student enrolling in a Course (“you” or “your”) that you accept and agree to abide by the Policies.
6. PLEASE READ THE FOLLOWING POLICIES CAREFULLY. BY ACCEPTING THE POLICIES YOU AGREE TO BE BOUND BY THEM. IT IS A CONDITION OF YOUR ENROLMENT IN A COURSE AND/OR USE OF AN ONLINE SERVICE THAT YOU COMPLY WITH THE POLICIES.
7. SAGE may amend the Policies from time to time. Please read the Policies carefully each time you log on as your use of an Online Service after SAGE makes amendments to the Policies will oblige you to comply with the Policies as amended.
Student Policies
1. Access and equity
1.1 You and other students have the right to learn in an environment free of discrimination, harassment and bullying. SAGE will not tolerate any form of discrimination, harassment or bullying.
1.2 You are responsible for providing SAGE in your application to a Course, with information that will help SAGE to help you achieve your learning objectives.
2. Awards
2.1 SAGE will award you a statement of participation for successfully completing a non-assessed, and/or a short Course.
2.2 SAGE will award you a statement of competence for successfully completing an assessable Course.
3. Attendance, assessment and plagiarism
3.1 SAGE will progressively gather evidence of your competence over the duration of a Course.
3.2 Missing sessions may compromise your ability to complete a Course successfully. It is your responsibility to catch up, should a session be missed. 3.3 If you are not successful in achieving competence you can re-enrol in the Course. Regular Course fees will apply. 3.4 SAGE does not tolerate plagiarism. If you are found to be committing plagiarism, SAGE will take appropriate action against you which may include your expulsion from your Course.
4. Continuous improvement
4.1 SAGE undertakes on-going improvement of its Courses. Improvements can include relevance of content, currency of technology, access to TTIM™, delivery and assessment strategies and support learning resources. SAGE consults regularly with past and current students, employers and industry in implementing continuous improvement.
4.2 You acknowledge that you will use your reasonable efforts to cooperate with SAGE to improve its Courses.
4.3 You acknowledge that the content of the Courses may change from time to time without notice.
5. Grievances and complaints
5.1 SAGE takes complaints and grievances very seriously. SAGE will investigate all complaints and grievances that are not frivolous, vexatious or lacking in substance, fairly and fully in a timely manner and take constructive action as required. If you have a complaint and/or grievance, contact your Course facilitator, or SAGE’s CEO on 1300 007 243.
6. Privacy
6.1 SAGE will not disclose your student information without your written consent.
6.2 SAGE will provide you with a record of your attendance, and assessment outcome on completion of an assessable Course. Your employer or line manager requesting information about you will be advised of this Terms of Use policy.
7. Occupational health and safety (“OHS”)
7.1 SAGE is committed to providing and maintaining a safe, healthy and hazard free working environment for you.
7.2 You must attend any OHS induction training at the commencement of any of Courses involving practical workshop activities.
8. Records
8.1 With the exception of non-assessed Courses, SAGE will hold your record of attendance and assessment outcome for a period of 2 years from its completion.
8.2 A statement of competence or statement of participation will be issued by SAGE on successful completion of a Course.
8.3 Requests for re-issuing will incur a fee of AUD $44.00.
9. Refund and withdrawal
9.1 Payment is required 4 weeks in advance of Course commencement to secure a position.
9.2 Withdrawal 28 days or more before Course commencement will attract a 75% refund, at 14 or more days a 50% refund, and less than 14 days, a 25% refund.
9.3 There is no refund after Course commencement.
9.4 No refund is available on short Course enrolments.
9.5 Where a short Course has been purchased by a prepaid coupon, there is no refund available on the Course, or on any unused coupons.
10. Selection for enrolment
10.1 As there are limited positions within most Courses, selection will be in the order that applications have been received, subject to payment being received at least 28 days prior to commencement.
10.2 Once available positions have been offered, remaining applicants will be placed on a waiting list in the event there is a withdrawal, or, offered a position in the next scheduled Course.
10.3 Selection criteria do not apply to short Courses.
11. Intellectual Property Policy
11.1 You acknowledge the intellectual property in SAGE’s Learning Resources including the trade marks TTIM™, TTIM Targeted Technology Introduction Modules™ and SAGE Didactic® and any other intellectual property rights in or associated with the Learning Resources used in the Courses are owned or licensed by SAGE (“Learning Resources” means all resources used and produced in a Course of or for use in teaching by SAGE in any form (including digital, print, video and visual material) and all intellectual property in such materials including lectures, lecture notes and material, syllabi, study guides, assessment materials, images, multimedia presentations, web content and Course software).
11.2 You must not do or allow any third party to do anything which may infringe, damage or endanger SAGE’s intellectual property rights or the intellectual property rights of a third party in the Learning Resources.
11.3 You will grant SAGE a non-exclusive, perpetual, fully-paid and royalty-free, irrevocable and worldwide licence (including a right to sub-licence) to use, reproduce, adapt and exploit, anywhere in the world any work or intellectual property you generate by your use of the Learning Resources but only in connection with SAGE’s business.
11.4 All rights are reserved. Any reproduction, duplication, or distribution of SAGE’s Learning Resources in any form outside of Course use is expressly prohibited.
12. Breach of policies
12.1 If you breach any of the above policies, SAGE reserves the right to take appropriate action against you including your expulsion from your Course.
Terms of Use Policy
1. General principles of use
1.1 SAGE is not responsible for the content of any data on or accessed through SAGE’s website that is not originated by SAGE. SAGE exercises no direct supervision or control whatever over the content of such data. SAGE does not assume any responsibility for data not actually provided or expressly authorised by it. The responsibility for data that does not conform with this Terms of Use policy and all possible consequences lie with the provider or sender of the data.
1.2 SAGE is not responsible if you misinterpret any of the data and/or if you fail to complete a Course provided via an Online Service.
1.3 SAGE does not represent that any Course you undertake will be suitable for your needs or that by undertaking any Course including any form of assessment via an Online Service, you will gain any particular knowledge, experience, qualifications, competencies or skills, even if the Course data says otherwise.
1.4 You are responsible for all use of your username and password. If you permit others to use an Online Service, you are responsible for making them aware of this Terms of Use policy and obtaining their compliance with the Policy.
1.5 You are responsible for complying with conditions of use of other web delivered services. If SAGE provides you with access to services outside it, you must comply with any acceptable use conditions which apply to that service.
2. Authorised user
You warrant that:
2.1 you are authorised to use the Online Services for which you are enrolled or in which you intend or attempt to enrol;
2.2 the username and password you are using to access an Online Service is yours;
2.3 you will complete any Course and in particular, any assessment component, provided via an Online Service yourself and no other person will complete any part of any Course for you or give you undue or improper assistance;
2.4 you will not give undue or improper assistance to anyone to complete any part of any Course provided via an Online Service;
2.5 you will not print, copy, store or transmit to a third party or allow anyone else to print, copy, store or transmit any Course data contained in an Online Service unless expressly authorised; and
2.6 you will refer any complaints or difficulties you may have regarding an Online Service or your use of an Online Service to the help desk listed on the SAGE web page relevant to the Online Service in which you are enrolled or in which you wish to enrol.
3. Acceptable uses
You must use the Online Services responsibly and within the law. It is your responsibility to:
3.1 use an Online Service in a manner which does not violate any applicable laws or regulations;
3.2 respect the legal protection afforded by copyright, trade mark, license rights and other laws to data accessible via an Online Service;
3.3 respect the privacy of others;
3.4 use an Online Service in a manner which does not interfere with or disrupt other users, services or equipment;
3.5 refrain from acts that waste resources or prevent other users from receiving the full benefit of the Online Services; and
3.6 use an Online Service lawfully, ethically and in accordance with accepted community standards.
4. Unacceptable uses
4.1 You must not use an Online Service in any way which breaches local, state, federal or international laws. Without limiting that, you must not:
4.1.1 violate copyright or other intellectual property rights;
4.1.2 illegally store, use or distribute software owned or licensed to SAGE;
4.1.3 transmit threatening, obscene or offensive materials;
4.1.4 misrepresent or defame others;
4.1.5 commit fraud;
4.1.6 gain unauthorised access to any computing, information, or communications devices or resources, including but not limited to any machines accessible via the Internet;
4.1.7 damage, modify or destroy any of SAGE’s or any other person’s files, data, passwords, devices or resources;
4.1.8 make an unauthorised transmission of confidential information or data protected by trade secrets;
4.1.9 engage in misleading or deceptive on-line practices;
4.1.10 conduct any business or activity or solicit the performance of any activity that is unlawful; or
4.1.11 attempt to do any of these things.
4.2 You must not use the Online Services to interfere with or disrupt SAGE’s platform or SAGE’s other users, services or equipment. In particular, for example, you must not:
4.2.1 distribute messages to inappropriate or unrelated forums, newsgroups or mailing lists (“spamming”);
4.2.2 send unsolicited commercial messages;
4.2.3 initiate or spread computer worms, viruses or other types of malicious programs;
4.2.4 make transmissions of any type or quantity which adversely affect SAGE’s operation or jeopardises the use of the Online Services, or their performance for other users; or 4.2.5 harass or impersonate SAGE or other users.
4.3 You must not use the Online Services to solicit others to become subscribers of other competitive services.
5. SAGE’S rights
5.1 You will indemnify SAGE and any other party with whom SAGE has a contract in relation to an Online Service (“other party”) for any damage, loss, cost, expense or claim that SAGE or the other party suffers as a result of any breach of this Terms of Use policy by you.
5.2 Without limiting any of SAGE’s other rights, if you breach any term of this Terms of Use policy, SAGE will have the right to:
5.2.1 confiscate or destroy or require you to return or destroy, at your cost, all material that you have obtained from any of the Online Services;
5.2.2 require you to delete or otherwise permanently remove from any electronic device, information you have obtained from the Online Services, using any means reasonably necessary;
5.2.3 suspend or terminate your access to the Online Services, without refunding any money you have paid to use any of the Online Services; and
5.2.4 take any other action against you.
6. What SAGE may do to ensure that this Terms of Use policy is being followed
6.1 SAGE may monitor your use of the Online Services to determine whether this Terms of Use policy is being followed. If SAGE monitors your use, SAGE will safeguard your privacy unless doing so would involve SAGE concealing a criminal offence or inhibit the enforcement of this Terms of Use policy.
6.2 If SAGE becomes concerned that your use of the Online Services may break the law or that you have not complied with the Policy, SAGE will generally attempt to contact you before taking action.
6.3 If SAGE believes that your use of the Online Services may break the law or that you have not complied with this Terms of Use policy SAGE may:
6.3.1 notify you by email;
6.3.2 suspend or terminate your access to the Online Services without notice; and/or
6.3.3 notify and provide relevant information to the authorities, as appears appropriate in the circumstances.
6.4 If SAGE takes action under clause 5 or this clause 6, SAGE reserves the right, in its sole discretion, to delete any or all of your data, software or other content stored on SAGE’s system.
7. Limitations
7.1 Whilst SAGE will make all commercially reasonable efforts to post a warning on this website, SAGE may from time to time suspend any or all of the Online Services or disconnect or deny access to its platform, without notice to you during any technical failure, modification or maintenance affecting the Online Services or this website, provided that SAGE will use commercially reasonable endeavours to procure the resumption of the Online Services as soon as reasonably practicable.
7.2 Without notice to you, SAGE may remove, amend or alter any material or data in the Online Services upon being made aware of any claim or allegation or risk of a claim or allegation that any such material or data is unlawful, defamatory, offensive or in breach of a third party’s rights.
7.3 SAGE will not be responsible for any interruption to or reduction or lack of performance in the Online Services however caused but SAGE will use commercially reasonable endeavours to maintain the performance of the Online Services where this is within SAGE’s direct control.
7.4 To the maximum extent permitted by law, SAGE will not be liable to you in any way for any costs, damages (including indirect or consequential damages), liabilities, claims, actions or proceedings which you may suffer or incur directly or indirectly as a result of or in connection with the provision of any of the Online Services or your use of them or any data on them.
